Hands-On Mobile, Inc. (hereinafter “Hands-On Mobile”) is the exclusive licensor of the Kitten Cannon video game created by Burst Studios. It has recently been brought to our attention that you have developed and distribute a mobile video game titled Cannon on Apple Inc.’s iTunes App Store. Your game’s name and designation are substantially similar to the Kitten Cannon’s copyright and common law trademark. Under these circumstances, your game’s name and designation are likely, if not certain, to cause confusion among the public. This game infringes on the rights of our exclusive license on the grounds of confusion with the Kitten Cannon game. We demand that you immediately cease all use of Cannon as well as any other designation confusingly similar to Kitten Cannon as a mark and trade name in connection with mobile video games. Furthermore, we demand that you disgorge your profits realized from the sale of the game on Apple Inc.’s iTunes App Store. We consider our intellectual property and the Kitten Cannon game to be extremely valuable assets. Accordingly, we request that you provide us with your written undertaking, within five (5) days from the date of this letter, that it will cease all use of the Cannon game and provide an accounting of the profits from this conduct. If we have not received a response by such date, we reserve the right to take legal action, including without limitation, initiating a lawsuit where we would be entitled to claim statutory damages. We hope that this matter can be resolved amicably and we look forward to your response.
